The Royal Bafokeng Nation is considering lodging an application in terms of the recently promulgated Restitution of Land Rights Amendment Act (2014). This project commissioned an experienced researcher, Prof Andrew Manson, to compile a list of potential pieces of land which fall within the criteria of the new Act.
Scope
Identifying any portions of land that conform with the conditions in Section 2(1)d of the Restitution of Land Rights Act (1994), namely land to which Bafokeng had collective rights but where they were “dispossessed of a right in land after 19 June 1913 as a result of past racially discriminatory laws or practices” and where section 2(2) does not apply.
Describing the location and extent of such land;
Collating and assessing the strength of supporting evidence as to both the Bafokeng claim to this land, and how it was dispossessed (including noting if any other groups or individuals may have a claim to the same land);
Making preliminary recommendations as to which portions of land are potential or promising candidates for claims, on the basis of the strength of the supporting evidence (legal advice will be sought separately)
